Kudler Legal Issues
Kudler fine foods is a local upscale food store in the San Diego metropolitan area. The company has three locations. Kathy Kudler took her passion and converted into a successful business. Kathy’s legal counsel is her sister-in-law Anne Shousha. Kathy has been able to keep legal costs to its minimum. There have been few customer accidents. Anne has advised Kathy to settle instead of litigation. Keeping in view that business laws is written to ensure fairness between companies and consumers. One accident or injury can literally close a company’s doors forever if sound legal strategies and precautions are not in place. Kudler Fine Foods will be vulnerable to lawsuits until they improve their legal counsel, liability precautions, incident reporting, contracts, nondisclosure agreements, software licensing compliance, and occupational safety. Companies must arm themselves with legal teams and contracts for protection from such adversaries.
Kulder uses very few custom forms, preferring instead to use contracts and order forms supplied by the other parties or off the shelf computer programs. (University of Phoenix, 2008). For example, the lessors supply the lease contracts on the stores. Kathy and her assistant modify forms thus obtained.
Anne Shousha specializes in tax law working with litigation matters of audits, fines, and liens etc. Kudler Foods is expanding its business and has a need to retain a legal counsel experienced in litigation of cases where plaintiffs seek monetary damages from the company, e.g. personal injury claims. Due to the nature of business that needs to write contracts, Kudler should also have a lawyer to review legal documents.
It is Kudlers business practice to give the storeowners the responsibility to keep their stores running safely.
