Many organizations contend with tort liability and regulatory risk in business. Preventive measures to limit the organization’s exposure to tort liability has become essential to effective operation as a business. This paper will identify the tort liabilities and regulatory risk’s of Alumina and a business plan to manage it. The prevention, detection, and corrective measures for each liability will be described. The best course of action to alleviate tort liability will be identified during this plan and the expected results of proper management for Alumina and any organization. The business simulation centered on Alumina; a company with previous liabilities that had action brought against the company five years ago. Alumina has current tort liabilities due to the previous lawsuit and recent complaints that compound potential risks to company.   The list of tort liabilities and regulatory risks are: Defamation,Negligence, Assumption of Risk, and Freedom of Information Act. These risks are the most serious and relevant when compared to Alumina’s current and prior liabilities.
Public accusation is made about the company claiming that they are still polluting the local water supply, which directly caused the leukemia of a young girl.   Alumina was found liable of this charge five years ago in a different case. Since that time the company has made necessary changes and are now in line with federal regulations. Alumina believes that this accusation is unfounded and is grounds for defamation against the company.   Defamation is the “publication of untrue and damaging statements about an individual or company” (Jennings, 2006, p.403).   Since the claim is rooted in prior poor performance by the company even though current documentation is lacking, public perception will be a central motivator in resolving the issue.
