A Permanent Death - Capital Punishment
Capital punishment, or the death penalty, was first used in the United States in colonial times. Since there were no prisons then, death was the punishment for a wide range of offenses. As the nation grew, laws regarding the administration of criminal justice were changed and refined and the death penalty was reserved for the most violent crimes. Public opinion about the death penalty has fluctuated over the years and there are concerns that innocent people have been executed or are waiting on death row. There are basic reasons that society uses when imposing punishment that I have been able to conclude from my readings. I will discuss these societal concepts and show that the death penalty does not serve to further them. As a result inmates should not be subject to the death penalty and in fact the same should be abolished from our system of punishment.
In the plainest of words, capital punishment is an outright violation of a person’s natural born rights. “The Universal Declaration of Human Rights recognizes each person's right to life (Article 3) and categorically states that "No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment" (Article 5). In Amnesty International's view, the death penalty violates these rights.” (Amnesty International). With these rights in place it seems completely contradictory of the justice system to allow for continued use of capital punishment. In recent years, the issue of capital punishment has been taken up by the Supreme Court as justices consider the constitutionality of executing the mentally ill and juvenile offenders. More than half of all countries have abolished the death penalty and the international community protests against U.S. death penalty laws.
