1. | Question : | Teddy's Supplies' CEO has asked you to advise him on the facts of the case and your opinion of their potential liability. Write a memo to him that states your view of whether the company is exposed to liability on all issues you feel are in play. Include in your memo any laws that apply and any precedent cases either for or against Teddy's case that impact liability. Include your opinion of the "worst case" of damages the company may have to pay to Virginia. | | | Student Answer: | | Mr. Moore, As per your request as to whether Teddy’s Supplies is potentially liable for the harassment charges the answer is “Yes”. Your company is liable for the conduct of your employees. You have a sexual harassment policy in place that was violated. Your employees created a hostile work environment that is clearly stated that “zero-tolerance” will be in place to keep a safe work environment. You also stated in your policy that harassing behavior is prohibited and banned. Although Ms. Pollard never filed a complaint but did mention she was being picked on. Mr. King was way out of line posting a sign that reads “HARDHAT REQUIRED/BRA OPTIONAL”. This type of behavior from management calls for serious reprimanding. Mr. King was quoted telling Ms. Pollard that she needs to “grow some balls” and “get over herself” when she told Mr. King she felt she was being picked on. These are all very serious allegations. Not to mention the truck incident or the slapping her backside incident. You have some stiff charges against the company. The worst case scenario for damages would be monetary and an apology from everyone who offended Ms. Pollard. Ms. Pollard’s attorneys could ask for amounts in the thousands.     Good day MS Kim, I would like to explain the available options of Access Control Lists what will do and what types of ACLs there are. Complex ACLs can be tricky but will better for security for the network. There are three different types of ACLs, Dynamic ACL, Reflexive ACL, and Time Based ACL. Each ACL is unique to the type of network we have. Dynamic are also called lock-and-key ACLs which only allow IP traffic only. Also the lock-and-key authenticates the user and permits limited access through the firewall router for a host for a time. Time Based ACLs are a specific time that traffic is allowed on the network. When the device determines that an ACL applies to a packet, it tests the packet against the rules. The first matching rule determines whether the packet is permitted or denied. If there is no match, the device applies a default rule. The device processes packets that are permitted and drops packets that are denied. “ACLs protect networks and specific hosts we would be able to specify certain days and hours of which the user will have access to the network. With this type of ACL there is more control over permitting or denying access to resources. Reflexive ACL allows outbound traffic from the network and limits the inbound traffic. This allows greater control over what traffic is on the network and able to expend the control list. Also, with Reflexive when ACL, an unknown IP address is trying to gain access, it will put the IP address in a temporary ACL group and will await replies from the network and the network will automatically remove the IP address when the session is over. It is probably in the best interest for our network to concentrate on Reflexive ACLs for these reasons;…

    | Dear Mr. Moore, After reviewing this case, I can state that Teddy’s Supplies is definitely liable for the workplace and sexual harassment against Virginia Pollard. According to the facts, it’s indicated that Ms. Pollard (plaintiff) was placed in a ‘hostile’ environment and Mr. Steve King was her supervisor. Although it is not illegal for 1 woman to work with a group of men, it should be carefully determined by the employer if the environment is suitable for males and females to work together. In this case, it was not a good idea for 1 woman to work with male associates. • Workplace environment can by justified by 7 ways: race, gender, national origin, religious, color, age and disability. In this case, Pollard was constantly being harassed by her male colleagues. They played pranks on her by locking her drawers shut, filling the guard shack with trash, locking her out of the guard shack and therefore she was not able to perform her job duty since she was responsible for watching warehouse inventory. Also, Ms. Pollard was put into unnecessary risk of harm when a coworker backed a forklift up to the guard shack and it backfire into her ear.
