Farenheit 451 Week 1 Reflection Paper
The US Constitution is one of the most important documents ever written in United States history. It is the law of the land and it covers the legal system as well. Article 3 explains the judiciary branch. The constitution states that the judicial branch is ran by the supreme court. Then it explains how trials are held, stating how they will be held at where the crime was committed. Then it explains the act of treason in section 3. It states that congress has to right to decide a punishment for the act of treason.

I believe the system works, it’s just that people are human and make mistakes here and there. I believe it is the human element that corrupts the criminal justice system. Eric Garner was a 6’3 African American male, who was killed by police after he resisted arrest. Garner was accused of selling single cigarettes outside a business. Police went to investigate and confronted Garner. After he resisted, he was put in a chokehold in order to be taken down. This resulted in him not being able to breathe and lose his life. My view of the incident was that too much force was being used. The police officers didn’t have much probable cause to arrest him in the first place, and then they proceeded to arrest him. In my opinion, the officer should have not put him in a chokehold. He could have used backup to take him down. The law states that, under NYPD, that chokeholds are illegal to use. The officer should have known this, and used another method to arrest Garner. Too much police force was used in this case. I believe also that the 14th amendment was violated in this case. The 14th Amendment gives equal protection to everyone under the law. I believe that because Garner was African American, he was stereotyped and arrested with little to no probable cause. This is a subject of consensus vs conflict. This is a conflict issue because not everyone agrees with my opinion.
